Extreme Heat at Work: Employer Obligations Under Korean Law

As extreme heat becomes more frequent and severe, protecting workers from heat-related illnesses has become an increasingly important workplace safety issue.

Employers should not only be aware of the health risks posed by extreme heat but also ensure compliance with the preventive measures required under Korean occupational safety laws. Below is an overview of the key obligations imposed under the Occupational Safety and Health Act (OSHA).

Definition of work in extreme heat

Work in extreme heat (폭염작업) refers to work performed for two or more consecutive hours in a location where the heat index (apparent temperature) is 31℃ or higher.

Where the heat index is 31℃ or higher

Employers must implement at least one of the following measures:

  • Install and operate appropriate cooling and ventilation equipment.
  • Take measures to reduce heat exposure, such as adjusting working hours.
  • Provide adequate rest breaks.

Note: If the heat index remains at or above 31℃ despite implementing measures 1 or 2, providing adequate rest breaks is mandatory.

Where the heat index is 33℃ or higher

Workers must be given at least 20 minutes of rest every two hours.

If providing rest breaks is difficult due to the nature of the work – such as disaster response or securing safety – the employer must instead take measures to reduce workers' body temperature, such as providing and requiring the use of personal cooling equipment.

Measures to prevent heat-related illnesses

Employers must also take the following preventive measures:

  • Keep thermometers and hygrometers readily available at the workplace.
  • Inform workers in advance about the symptoms, preventive measures, and emergency response guidelines for heat-related illnesses.
  • Where extreme heat work is performed, keep a daily record of the heat index and the measures taken, and retain the records until December 31 of that year.
  • Immediately call 119 (emergency services) if a heat-related illness occurs or is suspected.
  • Provide shaded rest areas for outdoor work.
  • Supply salt and clean drinking water at worksites where workers sweat heavily.

Workers’ right to suspend work and evacuate

The OSHA grants workers the right to suspend work and evacuate to a safe place where there is an imminent risk of an industrial accident.

The employer must take the necessary safety measures until the risk has been eliminated, and must not subject workers to any disadvantageous treatment such as dismissal or disciplinary action for legitimately exercising this right.

Penalties for non-compliance

An employer who fails to comply with these obligations may be subject to imprisonment for up to five years or a fine of up to KRW 50 million.

If a worker dies as a result of such a violation, the employer may face imprisonment for up to seven years or a fine of up to KRW 100 million. In addition, the employer may also face liability under the Serious Accidents Punishment Act (SAPA).

As the extreme heat continues, employers should review their workplaces to ensure that all legally required preventive measures are being properly implemented.
