False Reports Can Justify Discipline: MOEL's Updated Workplace Harassment Manual

July 2, 2026 - MOEL Updates Workplace Harassment Manual

The Ministry of Employment and Labor (MOEL) has released a revised Workplace Harassment Manual, making the first update in three years.

The Manual covers key aspects of the relevant legislation, including the definition of workplace harassment, determination criteria, employers’ obligations, and prevention and response systems. This version provides more detailed and practical guidance than the previous version.

Above all, the revised Manual extensively incorporates recent judicial precedents, providing clearer criteria and concrete examples to help employers make more objective and consistent assessments in practice.

The two most notable features of the revised Manual are as follows:

1. Repeated or False Reporting as Justifiable Grounds for Disciplinary Action

The manual expressly states that excessive or unfounded false reports can constitute justifiable grounds for disciplinary action.

In practice, many workplaces experience cases where employees repeatedly file complaints over minor interpersonal conflicts or personal grievances, file knowingly false complaints to harm a particular colleague, or submit false allegations in an attempt to obtain favorable personnel actions (e.g., avoiding disciplinary action or securing a transfer). In many cases, however, employers have been reluctant to take decisive action due to their duty to protect complainants, leaving them dragged along by problematic reports.

The revision is meaningful because it clarifies that companies now have a clear legal basis to respond firmly and proactively to the abuse of the reporting system.

2. Preventing “Self-Investigation” and Introducing Recusal Procedures for Investigators

The Manual prevents so-called “self-investigation” in cases where an employer or a representative of the employer  (CEO, registered director, general manager, HR/labor manager, plant manager, etc.) is reported as the alleged harasser.

In such cases, the accused individual must be excluded from the investigation process. The Manual recommends establishing a separate framework – such as having the auditor conduct the investigation directly and report to the board of directors, or engaging outside experts or an external organization to carry out the investigation at the company’s expense.

The Manual also requires that complainants must be informed of the overall investigation process. It recommends establishing a recusal procedure so that, where a complainant believes a particular investigator is unlikely to conduct a fair investigation, that person can be excluded upon request. In addition, to ensure fairness and objectivity, the Manual strongly encourages the use of investigation committees and the participation of outside experts.

What Employers Should Take Away

Workplace harassment compliance is no longer simply a matter of receiving complaints and conducting investigations. More than ever, employers need to establish a response system built on fair procedures and objective decision-making standards.
