There have already been three amendments to the Equal Employment Opportunity and Work-Family Balance Assistance Act by April of this year alone. Here is a summary of the changes made.
1. Expansion of Administrative Fines to Corporate CEOs for Workplace Sexual Harassment (Effective November 27, 2026)
Under the current law, workplace sexual harassment by an “employer”, “supervisor”, or “employee” is prohibited. Where the “employer” commits such an act, an administrative fine of up to KRW 10 million may be imposed. However, a corporate representative, usually the CEO, has been classified as a “supervisor” rather than an “employer”, and therefore has not been subject to the fine.
With this amendment, however, the scope of those subject to fines will be significantly expanded from just the “employer” to include the “employer,” the “corporate representative”, and any "supervisor or employee who is a relative of the employer or the corporate representative.”
2. Expansion of Paid Period for Infertility Treatment Leave (Effective November 27, 2026)
Currently, only two out of six days of infertility treatment leave are paid. With this amendment, the paid duration will be extended from two to four days.
3. Short-Term Childcare Leave (1-2 Weeks) Now Available (effective August 20, 2026)
Employees will now be able to take childcare leave in a short block of one or two weeks. Currently, using such short leave was practically impossible because the one-year leave period could only be split three times, and eligibility for childcare leave benefits requires at least 30 consecutive days of leave. With this amendment, however, employees will be able to take a one-time short-term childcare leave of 1 or 2 weeks within their total one-year entitlement.
4. Male Employees May Now Take Childcare Leave Before Childbirth (effective September 18, 2026)
Currently, childcare leave is available to pregnant female employees or employees (both male and female) who need to care for a child aged eight or younger (or up to 2nd grade in elementary school). With this amendment, male employees will also be able to take childcare leave before childbirth in order to care for their pregnant spouses.
5. Paternity Leave Can Now Start Before Birth (effective September 18, 2025)
Currently, paternity leave (up to 20 days) may be used only after childbirth. With this amendment, employees will be able to begin using this leave up to 50 days before the expected date of childbirth.
6. Spouse’s Miscarriage or Stillbirth Leave Introduced (Effective September 18, 2026)
A new leave entitlement will be introduced for male employees whose spouses experience a miscarriage or stillbirth. The leave may be taken for up to 5 days in total, with the first 3 days being paid.
7. Grounds for Refusing Reduced Working Hours for Childcare Narrowed (effective September 18, 2025)
Currently, when an employee requests reduced working hours for childcare, an employer may refuse the request if “it is impossible to hire a replacement employee” or if “it would significantly disrupt normal business operations.” With this amendment, the “inability to hire a replacement staff” has been removed as a valid ground for refusal.
Employer Takeaway
Employers should review the effective dates in advance and update their Rules of Employment, internal policies, HR guidelines, and leave procedures to ensure compliance. Early preparation will help reduce legal risk and operational disruption.
